Estate Settlement
The death of a
loved one is a difficult time and we can assist you with the estate
settlement process. Depending upon the structure of the estate plan, estates
can be settled through the probate of a will, through the settlement of a
revocable living trust, or through a combination of both.
Generally
speaking, the settlement of an estate consists of collecting the assets,
paying taxes, settling creditor claims (if any), preparing accountings
and making distribution to the ultimate beneficiaries. However,
determining the best way to handle a particular estate settlement should be
done in consultation with an experienced estate attorney who can advise you
as to the many requirements and potential pitfalls which can occur in settling
Florida estates, including those instances where the person settling the estate can
be held personally and financially liable for certain actions as well as
inactions.
Please review the
sections on Probate and Trust Settlement for more detailed information.
